Terms and conditions

1. Definitions

• Fyldd — the software service (web and app) of Bitvire for work orders, scheduling, hours, materials and invoices.
• Customer — the company or self-employed person that uses an account.
• User — a person (technician or office employee) who logs in on behalf of the customer.
• Subscription — the paid contract that gives access to Fyldd.

2. Account and trial period

You create an account for your company and start with a free trial period of 14 days, without a credit card. During the trial period you can use Fyldd in full. If you do not take out a paid subscription after the trial period, your account becomes read-only: your data is kept and remains visible, but you can no longer create or change any data until you activate a subscription.

3. Price and payment

The subscription costs € 39 per month for your company (including the owner), plus € 19 per month per extra teammate. Yearly that is € 390 per year for your company and € 190 per year per extra teammate (that is two months' saving). The amounts stated are excluding VAT. You add teammates as you grow and only pay for who joins in. Payment goes via our payment provider Mollie with iDEAL or SEPA direct debit. The subscription renews automatically at the start of each new period, until you cancel.

4. Cancellation

You can cancel at any time. You keep access until the end of the period already paid for; after that the payments stop and your account becomes read-only. No refund is given for a current period.

5. Obligations of the customer

• You keep your login details secret and are responsible for use via your account.
• You do not use Fyldd for unlawful purposes or in breach of the law.
• You are responsible for the accuracy and lawfulness of the data you enter, including data about your own customers.

6. Availability

We do our utmost to keep Fyldd stable and reachable and make regular backups. However, we do not offer guaranteed availability (no 100% SLA): maintenance, faults or causes beyond our control may interrupt the service temporarily.

7. Liability

Our liability is limited to direct damage and to at most the amount you paid for the subscription in the twelve months preceding the damage. We are not liable for indirect damage, consequential damage, lost profit or loss of data, except in the case of intent or deliberate recklessness on our part.

8. Intellectual property

The software, the design and the name Fyldd remain the property of Bitvire. The data you enter remains yours; you can export it and we make no use of it other than what is necessary to provide the service.

9. Business use

Fyldd is supplied for business use only, to companies and self-employed entrepreneurs. The statutory right of withdrawal for consumers therefore does not apply.

10. Changes

We may change these terms and the service from time to time. In the case of material changes we inform you in advance. If you continue to use Fyldd afterwards, the new terms apply.

11. Applicable law

Dutch law applies to this contract. Disputes are submitted to the competent Dutch court. See also our privacy statement and data processing agreement.
